Terms of Service

These terms govern use of FinalSale ("the Service"), provided by Ballin Brothers LLC ("we", "us"). By creating an account or connecting a TikTok Shop, you agree to them.

1. The Service

FinalSale automates customer-service replies and return-request handling for TikTok Shop sellers who run live auctions, according to rules you configure. You remain the seller of record and responsible for your shop, your listings, your buyers, and compliance with TikTok Shop policies and applicable law.

2. Eligibility and accounts

You must be at least 18 and authorized to act for the TikTok Shop you connect. Keep your login secure; you are responsible for activity under your account.

3. Authorization and data

By connecting your shop you authorize us to access it through TikTok Shop's APIs under the permissions you grant, and to act on your behalf as described in the app. Our Privacy Policy explains how we handle data. You can revoke access at any time by disconnecting your shop.

4. Automated actions

The Service sends messages and makes return decisions automatically based on your settings and TikTok Shop's policies. You are responsible for reviewing your settings and the action log. We do not guarantee any particular outcome of a dispute, appeal, or buyer interaction, and we are not liable for refunds, chargebacks, lost sales, or shop penalties.

5. Acceptable use

Do not use the Service to violate TikTok Shop policies, deceive buyers, send unlawful or abusive messages, or interfere with the Service. We may suspend accounts that do.

6. Fees

Some features may require a paid subscription. Prices and billing terms are shown in the app before you buy. Fees are non-refundable except where required by law.

7. Intellectual property

The Service, including its software, design, and content, belongs to Ballin Brothers LLC. You keep ownership of your shop data.

8. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, or consequential damages.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts for breach of these terms. Sections 4, 7, 8, and 10 survive termination.

10. Governing law

These terms are governed by the laws of the State of Wisconsin, USA. Disputes will be resolved in the state or federal courts located in Wisconsin.
